District Attorneys Call Uber, Lyft, And Sidecar A Continuing Threat To Consumers

Bad news hit the desks of ride-share company execs this week: The district attorneys of S.F. and L.A. have teamed up to investigate Uber, Lyft, and Sidecar for a handful of practices that they assert are in violation of state law. It's the latest in a series of hurdles the companies have faced in gaining legal recognition for providing the service of taxis while insisting that they are not really taxis.


As the Chronicle and others are reporting, the two DAs' offices sent the letters on September 24th promising injunctive relief and civil penalties if the companies did not change certain policies and practices "quickly." At issue are several problems with safety and fairness that have mostly been talked about before, and the DAs call these four issues in particular "a continuing threat to consumers and the public."
  • The case of UberX driver Daveea Whitmire — the 28-year-old driver with a criminal record (including prison time) who's been charged in an assault on a passenger last November — plays a starring role in this current kerfuffle. S.F. DA George Gascon says he wants all three companies to "remove all statements from their mobile apps, websites and other publications that imply their background checks reveal drivers’ complete criminal history," calling such claims "patently untrue." (You may recall that Uber contracted with a company called Hireaseto do their background checks, and that company either failed to check on Whitmire or somehow missed his previous felonies.)
  • There's the much discussed issue of Uber, Lyft, and Sidecar's lacking the proper licenses to pick up and drop off passengers at airports.
  • Recently launched carpool options, including UberPool, are illegal as we heard a few weeks ago, and the DAs are saying these have to cease immediately. Under state law, the cost of all taxi fares must be split evenly between passengers sharing a single ride unless the company is a "passenger stage corporation" like SuperShuttle. UberPool allows users to share rides for cheaper fares, however the fares are not divvied up to add up to an equivalent single fare.
  • Also, like normal taxis, ride-share companies have to be "regulated by the state’s Department of Food and Agriculture’s weights and measures division, which regulates everything from groceries to gas stations to taxis to ensure that customers are getting the amount of food or gas or number of taxi miles they’re paying for."
There's nothing in this latest round of letters relating to the ongoing issue of ride-share drivers' and their insurance, but that seems to be getting worked out at the state level.
Sidecar CEO Sunil Paul shared the letter he received with the Wall Street Journal, saying, "We're frankly disappointed and a little baffled that there would be all of this pushback."
In a statement, Gascon says, "We value innovation and new modes of providing service to the public. However, we need to make sure the safety and well-being of consumers are adequately protected in the process.”

Why Uber Drivers Say It Sucks to Be Them

Uber drives organized their first protest this week in Los Angeles over what sound like some pretty raw working conditions. A new union of Uber drivers (California App-Based Drivers Association) has just joined a Teamsters chapter and is speaking out against new fare reductions (which now make Uber cheaper than LA's buses), a huge increase in the commissions taken out by Uber, a "misleading tipping policy," and the company's rating system, which gives all the weight to reviews from riders, regardless of how horrible they may be, reports Neon Tommy. Here's a list of working conditions the Uber drivers want to change:

· "Uber used to take only a 5 percent commission from drivers' total fares. That number has now risen to 25 percent," says Joseph De Wolf, an Uber Black driver who is also also cofounder and executive committee member of the new union. (Uber also takes a dollar off the top of every ride as a "safe ride fee.")

· That is pretty nuts on its own, but it's also been coupled with a hefty fare cut. According to DeWolf, in December 2013, UberX (the least expensive Uber service) charged $2.40 a mile, with a base rate of $4; now the rate's just $1.10 a mile, with a base rate of eight cents.

That's especially painful considering that, as independent contractors, drivers have to pay for their own gas and car-related expenses. Eighty cents of gas is not going to get anyone anywhere.
· The company's rating system, which has riders rate drivers, uses one- to five-star grading. Drivers whose average dips below 4.7 stars get a warning email and are deactivated until they take a class about improving their rating; if their rating goes below a 4.4 after the class, they're permanently deactivated, which amounts to being fired.

· This is probably a well-intentioned attempt to hold drivers to high standards, but the effect is often that drivers who are asked to do potentially unsafe things (like, say, fit eight people into a car) are worried that if they don't do what their fare wants, it could result in them being fired.

· Drivers also take serious issue with the impression that Uber gives users about tipping. As one Uber driver put it, the company "brainwashes the public, saying the tip is included. It's never been included."
Uber, for its part, says it's reducing fares for a really good reason. "We just want to be the biggest company in the world, whatever we need to do to find more clients," a general manager with Uber said.

How to Delete Uber Account

It's been a rough week for Uber. First, private comments were made public. Then"God View" was revealed. Finally, Ashton Kutcher, an Uber investor, took to Twitter to throw-in his two and a half cents.
The combination of recent events have forced many to proclaim they'll never use the service again. Simply deleting the app from your phone will eliminate it as an option the next time you're in need of a ride, but your account will remain active. To complete your boycott, you'll also want to delete your Uber account.
Deleting your account isn't an automated process. Here's what you need to do:
  • Visit Uber's support site.
  • Fill in the required fields with your Uber account info. Be sure to put "Cancel my Uber account" or a variation of it in the subject line.
  • In the body of the message, provide the rest of your account information (name, phone number).
  • Select your Uber city.
  • Send.
After a few days, you'll receive a reply indicating your account has been canceled. You can delete the app from your phone at any time, or wait until you receive a response from support confirming your account has been closed.
Keep in mind, however, just because your account is canceled doesn't mean Uber has deleted your personal information. In fact, section 8 of its privacy policy clearly states it will keep your info (including payment information) until it determines it's no longer needed for business purposes. Whenever that is.

Why Uber Sucks

I hate driving for Uber


Not so much because of the lies they tell before you sign up about how much money you will make. Not even because of their douchebag logic that you will somehow make more money by earning less per ride after their fare cuts. I hate Uber because of the minority of a**hole/bitch riders.


One bitch said "Umm, is there any water in this vehicle?"


Yes, I believe that there is some in the car's radiator. It is mixed with the refrigerant ethylene glycol, which is highly toxic and may cause instant death if swallowed. Shall I try to get some out for you?"

Yeah, I really am a free mobile 7-Eleven. Free water, snacks and treats, my ass. Do I go into a 7-Eleven and say to the clerk that 

I want a free bottle of water and gum and, oh yeah, when you've done that you can drive me downtown in exchange for $2.40?

No, I do not.  I'm not like other Uber drivers out there who gives out water for 5 stars rating.
